Extraordinary Power of Supreme Court
The Supreme Court shall have extraordinary power to declare any law void if inconsistent with the Constitution, and to issue writs of habeas corpus, mandamus, certiorari, prohibition and quo warranto for enforcement of fundamental rights.
The Supreme Court can: (1) Strike down any law that violates the Constitution (constitutional review), (2) Issue habeas corpus to free wrongfully imprisoned people, (3) Issue mandamus to force government to do its legal duty, (4) Issue certiorari to review lower court decisions. These are the most powerful legal tools in Nepal.
