Art. 300 · Part 33

Transitional Justice

संक्रमणकालीन न्याय
Original Text

The Government shall constitute a Truth and Reconciliation Commission and a Commission on Investigation of Enforced Disappeared Persons to investigate human rights violations during the armed conflict (1996-2006).

💡 Plain Language Explanation

Nepal\'s decade-long Maoist conflict (1996-2006) left 17,000+ dead and 1,300+ disappeared. This article mandates TWO commissions: a Truth and Reconciliation Commission (for conflict-era atrocities) and a Disappeared Persons Commission (for the 1,300+ still missing). Both were finally formed but have been criticized for delays and lack of prosecutions. Victims still await justice.

🇳🇵 नेपाली व्याख्या

सत्य तथा मेलमिलाप आयोग र बेपत्ता छानबिन आयोग — सशस्त्र द्वन्द्वकालीन मानवअधिकार उल्लंघनको छानबिन।

✅ Strengths

Constitutional mandate for transitional justice — rare in post-conflict constitutions.

⚠️ Concerns

Both commissions have been widely criticized for political interference, delays, and failure to deliver justice to victims.
