Interpretation of Constitution
The Supreme Court\'s Constitutional Bench has the final authority to interpret the Constitution. Constitutional interpretation must promote the spirit and objectives of the Constitution.
When people disagree about what the Constitution means — \'Does Article X allow this?\' or \'Does Article Y protect that right?\' — the Supreme Court\'s Constitutional Bench has the FINAL say. No other body can overrule their interpretation. This power has been used to settle major disputes: PM dissolution cases, citizenship controversies, and rights questions.
संविधानको व्याख्या गर्ने अन्तिम अधिकार सर्वोच्च अदालतको संवैधानिक इजलासमा।
Centralized constitutional interpretation prevents conflicting interpretations across courts.
The Constitutional Bench has been slow to form at times, leaving major questions unanswered for years.
