State of Emergency

If a grave emergency exists whereby the security or existence of Nepal is threatened by war, external aggression, armed rebellion, or extreme economic disarray, the President may declare a State of Emergency on PM recommendation.

💡 Plain Language Explanation

Emergency powers can suspend constitutional rights and give government extraordinary powers. BUT: (1) Parliament must approve within 30 days by 2/3 majority, (2) Cannot be extended beyond 3 months without re-approval, (3) Fundamental rights restoration required when lifted. Nepal's last emergency was 2005 under King Gyanendra - the constitution prevents this repeating without parliamentary consent.
