Art. 163 · Part 13

Provincial Attorney

प्रदेश न्यायाधिवक्ता
Original Text

Each Province shall have a Provincial Attorney, appointed by the Provincial Chief on recommendation of the Chief Minister, who serves as the Province\'s chief legal advisor.

💡 Plain Language Explanation

Just as the federal government has an Attorney General, each province has its own Provincial Attorney — the province\'s top lawyer. Appointed by the Governor on the CM\'s recommendation, they represent the province in court, advise on legal matters, and decide whether the province should sue or be sued. They mirror the AG\'s role at the provincial level.

✅ Strengths

Ensures each province has independent legal counsel, not dependent on Kathmandu.

⚠️ Concerns

Provincial attorneys are often underresourced and lack the stature of the federal AG.
