Independence of Judiciary
The independence of the judiciary shall be maintained. No interference shall be made with the judicial function. Courts and judges shall decide cases independently, without outside pressure.
This is the constitutional firewall between politics and justice. No PM, no minister, no party leader can tell a judge how to decide a case. No government office can obstruct or delay court proceedings. Judicial independence means judges answer only to the Constitution and the law — not to any political master.
न्यायपालिकाको स्वतन्त्रता अक्षुण्ण राखिनेछ। कुनै बाह्य हस्तक्षेप गरिने छैन। न्यायाधीशले संविधान र कानुन मात्र मान्छन्।
Constitutional guarantee of judicial independence is the strongest form of protection.
Political interference in judicial appointments and executive non-compliance with orders undermine this guarantee in practice.
