Military Court

सैनिक अदालत
Original Text

A Military Court may be established to try cases relating to military offences. Criminal cases involving imprisonment over one year cannot be tried by non-court bodies.

💡 Plain Language Explanation

Military courts exist for military discipline — AWOL, insubordination, military-specific crimes. But here\'s the crucial safeguard: any criminal case that could result in more than 1 year in prison MUST go through regular courts, not military ones. Soldiers accused of serious crimes face the same justice system as civilians.

🇳🇵 नेपाली व्याख्या

सैनिक अदालत सैनिक अपराधका लागि मात्र। १ वर्ष भन्दा बढी कैदको मुद्दा सामान्य अदालतमा जान्छ।

✅ Strengths

Limits military court jurisdiction — prevents parallel justice system for serious crimes.

⚠️ Concerns

In practice, military investigations of their own personnel lack transparency.
